OptIn.de MEMBERSHIP AGREEMENT.

2.) We will delete any email address from our database that is not reachable without asking any questions why.

And it doesn`t matter if your email is just temporarily or permanentely down!

Further you will loose all money from email to you or to your referrals and you will loose your referrals as well!

3.) You admit to hold us harmless due to damage out of unreachable servers or other technical malfunction.

This agreement describes the entire terms and conditions for 
participation in the OptIn.de Membership Program. In this agreement, 
the term "Member" refers to you (the applicant).

Whenever the agreement refers to "you" or "your", it means 
"Member", "we" or "our" refers to optin.de  owners of the 
OptIn.de Membership Program.

ELIGIBILITY 
An individual becomes a OptIn.de Membership by completing and 
submitting the online Membership Enrollment Form.

The Member must be of legal age to participate in the state, 
province or country in which they reside. 
Each individual may only maintain one Membership at a time.

COST
Membership is FREE. 
All members may take advantage of our affiliate program. 
There is no cost to become an affiliate. 
If a member or affiliate wishes to use the email service to 
send mail to a list they will be charged the same fee as our advertisers.

CUSTOMERS 
Individuals who become OptIn.de Members are deemed to be 
customers of  OptIn.de. Accordingly, all OptIn.de rules, 
policies, and operating procedures concerning customer 
orders, customer and service will apply to those customers.

RELATIONSHIP OF PARTIES 
OptIn.de and the Member are independent contractors, 
and nothing in this Agreement will create any partnership,
 joint venture, agency, franchise, sales representative,
 or employment relationship between parties.

You will have no authority to make or accept any offers or 
representations on our behalf.

OptIn.de Members are expressly prohibited from stating or 
implying, orally or in writing, that they are franchises, joint 
venture partners, partners, or  employees of optin.de.

OptIn.de Members have no authority to speak on behalf of OptIn.de .

LIMITATION OF LIABILITY 
We will not be liable for indirect, special, or consequential damages
(or any loss of revenue, profits, or data) arising in connection with this
Agreement or the Program, even if we have been advised of the 
possibility of such damages.

COMMUNICATION 
OptIn.de is an Internet based program and therefore uses email 
and Internet web pages as communication devices.

All OptIn.de Members must have a valid email address 
and must notify OptIn.de if that address changes.

Any information posted on our website or emailed to the 
Member's email address of record is considered 
delivered to the Member.

UNCOMMISSIONABLE EMAIL
Email updates and notices are not commissionable. 
They are for notification and to inform our database of 
updates, enhancments, communication, and customer service. 
Also, any resend for merchants due to malfunction or 
misfortune is not commissionable.

ADVERTISING
Members may advertise their OptIn.de Member Site using any of the
advertising banners, links or material produced by OptIn.de and made
available on our website. No one may use the OptIn.de name or logo on
any materials not produced by OptIn.de without written permission
from OptIn.de. OptIn.de Members are prohibited from granting media
interviews regarding OptIn.de.

UNSOLICITED COMMERCIAL EMAIL 
(SPAM) OptIn.de in no way participates in mass unsolicited emailing (i.e. spamming), and all Members are expected to adhere to this policy as well. 
Violation of this policy will result in termination of this contract, and immediate dismissal from the OptIn.de Membership Program, with no refund.

Further more any service interruptions of OptIn.de as a result of your spamming will be billed to you at 
EU 1000.00 per hour until service is restored.

What is Spam?

Spam is emailing anyone, in bulk or by single mailing, about OptIn.de, who has not specifically requested the information directly from you.

The onyl exception to this is mailing to appropriate opt-in mailing lists where the source does the mailing on your behalf.

NOTE: Use extreme caution when choosing an opt-in mailing list company. 
Using anything but the most reputable sources will likely generate Spam complaints against you resulting in suspension or termination. OptIn.de also considers any type of advertisement about  OptIn.de posted to a Newsgroup or Chat Room to be Spam.

This would include references to OptIn.de in your signature. This would also 
include Newsgroups or Chat Rooms that allow advertising. Violators will 
be fined at EU 250.00 per incident.

TERRITORIES There are no territory exclusives in the OptIn.de Membership Program.

TERMINATION 
Any Member who wishes to terminate their status may do so by loging onto our 
Members Area and and clicking cancel account.

Resignation or termination of any OptIn.de Membership results
in the permanent loss of the rights to his or her organization.

DISCLAIMERS 
We make no express or implied warranties or representations with 
respect to the Membership Program or your potential to earn income
from the Membership Program. In addition, we make no representation
that the operation of our site or the OptIn.de Sites will be uninterrupted 
or error-free, and we will not be liable for the consequences of any
interruptions or errors.

INCOME CLAIMS 
OptIn.de Members are expressly prohibited from making any 
representations regarding the income potential of the Program.

AMENDMENTS 
OptIn.de may amend this Agreement, its prices, and its sales, marketing,
and commission plan at any time. Amendments will be communicated by posting them
on the OptIn.de website or by email. Amendments are effective and binding
upon being published on the website or upon the sending of an email notification.

PRIVACY STATE MENT

Some of the Information collected by OptIn.de is only used for internal use. 
This includes your name, address, email address, phone number, and Internet Address (IP Address).

This information will be used solely by OptIn.de to contact you about updates to
our program, keep your member information current, and to provide payment to you.

Demographical information about you, including birth date, gender, marital status, 
and interests are collected to send you paid advertisements corresponding to your information.

This information will never be given to paying advertisers, since OptIn.de handles all e-mailing itself.

At this time, the only way to become a member of OptIn.de is by filling out our signup form.

The information you provide us serves two purposes. 
One of these purposes is for OptIn.de to contact you regarding updates to our program 
and other essential contacts between the company and its members.

The other purpose is to match you with paying advertisers using the demographic
information you provide upon signup.

OptIn.de reserves the right to post Member Information on two portions of our site.
One of these named portions will be dedicated to listing the top ten referers to our program.

Information that will be posted will include First and Last Initials, Member ID, and Signup Date. 
The other portion of our site where Member Information will be posted is on our Cheaters Section.

We have a ZERO Tolerance against cheating!

Any member deemed to be cheating our program, depending on the seriousness of the 
fraud involved, automatically forfeits their coverage under our Privacy Policy.

We hereby claim the right to post any and all information provided by any Member
that has attempted to fraud our company.

We believe this will make members seriously consider their actions before attempting to cheat.

We will not post every cheating offense on this page, just the ones we deem to be malicous.
